Terms of Service

By signing up and actively using Destination-Mails you agree to all terms and conditions set forth in this agreement.

Destination-Mails may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members.

Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with any of SugarBear Enterprises program.

If any modification is unacceptable to you, your only recourse is to terminate this agreement.

Your continued participation in the Destination-Mails following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members:

You must be 18 years of age or older to participate in this program.

Our program is open to both US and International members and is void where prohibited by local governing laws.

We will only accept members from the following Countries:

We accept members from the following countries: Austria, Austrailia, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Italy, Netherlands, New Zealand, Norway, Portugul, Spain, Sweden, Switzerland, United Kingdom, & United States.

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity.

You may not sign-up multiple times with different email addresses on same individual Site of Destination-Mails.

Your computer must not be shared with another individual that has an existing same individual site account of Destination-Mails.

You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.

You are solely responsible for any and all use of your Destination-Mails account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Destination-Mails be detected it may result in member termination and possible legal action.

Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up with Destination-Mails. You agree to receive e-mail advertising from Destination-Mails limited to no more than (100) per day.

In the event your e-mail account on file becomes closed or blocked to messages from Destination-Mails, your account will be terminated. This especially applies to e-mail accounts returned for being Full.

Any member sending us gibberish (including but not limited to emails sent in ANY language other than English) will result in automatic termination of account and Forfeiture of All earnings to date of termination.

Auto-responses will also be deleted immediately.

Any member sending us spam, or abusive, or threatening, or inappropriate email(s) will result in automatic termination of account and Forfeiture of All earnings to date of termination.

Members who have not Logged In to Account AND Click an Advertisement in 60 days will be considered INACTIVE and their account will be terminated for Inactivity. If you need to be on vacation mode for more than 60 days, you need to contact the webmaster of site and get permission PRIOR to setting your account on vacation mode for more than 60 days.

You may not sell, gift or transfer your account to any other person. If you no longer wish to be a member of Destination-Mails your only recourse is to go to your user information and delete your account. Any account found to be sold or put up for sell, gifted, or change of ownership shall be in violation of terms of service and subject to termination.

Relationship of the Parties:

You and Destination-Mails are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Destination-Mails. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Destination-Mails. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:

Destination-Mails will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Destination-Mails, even if Destination-Mails has been advised of the possibility of such damages. Furthermore, Destination-Mails aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

If a Webmaster, Program Owner, Manager, Partner or Advertiser of any site owes Destination-Mails Money (or Destination-Mails Owners or Managers) - and they are past their own terms of service - their accounts will be placed in suspension. And All Advertising will be Cancelled until they come within Their own Terms of Service.

CHEATING :

It is your responsibilty to read and check off appropriate Keyword Selections in the "User Account Info" Area. Selecting inappropriate keywords will result in the account being suspended or terminated.

Should any instances of cheating be found either by use of Paid2Read Email Program Optimizers or other "cheating" software, multiple accounts on a single computer, invalid paid2signups whereby credit is attempted to be ascertained by submission of a confirmation email where the signup referrer is found not to be the direct upline, Destination-Mails will delete that member's account.

Once an account is deleted for cheating that member gives up their right to Privacy, meaning we may and will share your username, email address, name, and IP number with other webmasters. The deleted member also gives up any right to earnings that may have resulted from the cheating. The deleted member gives up any rights to referrals and downline earnings that resulted from the cheating.

CHEATING can be defined as:
1. Creating multiple accounts (on same site)
2. Use of optimizing software
3. Attempting to receive multiple credits for sign up tasks.
4. Receiving more than 30 Bad Turing Clicks in a given month.

On occasion Destination-Mails may add a "Cheat Protection Link" located in Disclaimer area of each email or Cheat Protection Banner Located in the Paid to Click Section(s) After the third time you click the link your account will be paid in full and deleted and will not be allowed to return! The link will be clearly labeled. If you click this link it simply means to Destination-Mails that either you cannot read English as is required by this program, you are using cheater software, or you are not reading the emails before you click. We will also employ the use of click bot dection software - any account dectected by this software will be terminated.

ANY MEMBER WHO HAS THEIR ACCOUNT TERMINATED FOR CHEATING OR FRAUD - WILL BE SUBJECT TO COLLECTIONS OF ALL PREVIOUS EARNINGS THAT HAVE BEEN PAID TO MEMBER - INCLUDING ANY ATTORNEY OR COLLECTION FEES THAT MAY BE INCURRED TO COLLECT SUCH A DEBT OWED TO DESTINATION-MAILS.

Advertising:

Guidelines

ALL Advertising Must be written in English language and website being advertised MUST be written in English Language.

Any Member who purchases and/ or Redeems for an ad from boycotted sites, non-english, porno, warez, hate, or other non- allowed advertisement - will forfeit the amount of redemption or payment.

Any Member who purchases and/or redeems for an ad from boycotted sites, porno, warez, hate, or other non-allowed advertisement - May also be Suspended or Deleted as a Member of Destination-Mails.

Unsuitable Content. The following types of sites are NOT allowed: Sites containing gambling, nudity, pornography, tobacco or other adult material, sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites that promote or utilize software or services designed to deliver unsolicited email, Sites that are owned by webmasters that use unfair or questionable ethics towards members, or any other sites Destination-Mails deems to be inappropriate. We reserve the right to refuse Unsuitable Advertisements.

We will no longer accept credit card payments.

Disclaimer

Destination-Mails IS NOT a get rich quick scheme. We offer members the opportunity to be paid for reading emails and visiting advertisers websites.

Referral Earnings are a BONUS - Affiliates are NOT required to recruit new members, sell or buy advertising to earn from Destination-Mails!

Destination-Mails is not resposible for content, claims, goods or services from 3rd party advertisements.

Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Destination-Mails and may result in legal prosecution. Destination-Mails strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Destination-Mails may charge up to $5 per spam email sent.

Destination-Mails will file charges for recovery of any earnings received from or advertisers who have violated the above terms.

Payments

Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Destination-Mails .

Members may earn by referring new members to the Destination-Mails program.

Members will earn a percentage of advertising revenues collected by Destination-Mails .

Destination-Mails will pay members when their balance reaches the minimum payout rate set of $0.01.

Paypal Payments will be made weekly, E-gold payments will be made within 30 days of requests.

Destination-Mails reserves the right to make additional payments or random payments at anytime during the month.

Members will be paid when their accounts have been reviewed. If their account is any violation of terms of service - their account will be placed on suspension and member will have 14 days to contact the website and correct the violation(s). And they will be passed over until next payment period.

Destination-Mails Reserves the right to add any other future processor that will be acceptable to site owner and members.

Members who do not accept payments or payments are returned will forfeit payment.

All Payments will be made in a mass payment function, when ever possible.

Members MUST have correct payment information filled out.
